Agreement to Terms

These Terms of Service govern your use of Create How's website and services. By accessing or using our website, enrolling in courses, or engaging with our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

1. Definitions

"Service" refers to content creator courses, training programs, and educational materials provided by Create How.

"User," "You," or "Your" refers to any person or entity accessing or using our services.

"We," "Us," or "Our" refers to Create How, its employees, instructors, and authorized representatives.

"Content" includes all course materials, videos, documents, software, and other information provided through our services.

"Platform" refers to our website, learning management system, and any applications we provide.

2. Eligibility and Account Registration

Age Requirement

You must be at least 18 years old to enroll in our courses and use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

Account Responsibility

If you create an account on our platform, you are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and not share it with others
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason we deem necessary to protect our services or other users.

3. Course Enrollment and Payment

Course Fees

Course fees are stated in Singapore Dollars (SGD) and must be paid in full before course commencement unless a payment plan has been arranged. All fees are non-refundable except as specified in our refund policy.

Payment Processing

Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge the applicable fees to your chosen payment method.

Refund Policy

Refund requests must be submitted in writing within 7 days of course commencement. Refunds are provided as follows:

  • Before course start: Full refund minus administrative fee (10%)
  • Within first week: 50% refund if less than 25% of course content has been accessed
  • After first week: No refund available

Refunds are processed within 14 business days to the original payment method. Course materials must be returned or access revoked for refund eligibility.

4. Use of Services

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these terms. Specifically, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of Create How or others
  • Share course materials with non-enrolled individuals
  • Record, copy, or distribute course content without authorization
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Engage in any conduct that disrupts or interferes with our services
  • Upload malicious code, viruses, or harmful content
  • Harass, threaten, or harm other users or instructors
  • Impersonate any person or entity
  • Use automated systems to access our services without permission

Course Participation

Active participation in courses is encouraged but not mandatory unless specifically required. You are expected to:

  • Attend scheduled sessions or access recorded content within designated timeframes
  • Complete assignments and projects to the best of your ability
  • Engage respectfully with instructors and fellow students
  • Provide constructive feedback when requested
  • Follow course-specific guidelines and requirements

5. Intellectual Property Rights

Our Content

All course materials, including videos, documents, presentations, software, and other content provided by Create How, are our intellectual property or licensed to us. This content is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use course materials solely for your personal educational purposes. You may not:

  • Reproduce, duplicate, copy, or resell any course materials
  • Modify, adapt, or create derivative works from our content
  • Share course access credentials with others
  • Upload course materials to public websites or file-sharing platforms
  • Use course content for commercial purposes without written permission

Your Content

When you submit assignments, projects, or other content through our platform, you retain ownership of your work. However, you grant Create How a non-exclusive, worldwide license to use your content for educational purposes, including:

  • Providing feedback and instruction
  • Displaying work as examples to other students (with your permission)
  • Using anonymized work for curriculum development

Trademarks

"Create How" and our logo are trademarks. You may not use these marks without our prior written permission. Other trademarks, service marks, and logos used on our platform belong to their respective owners.

6. Disclaimers and Limitations of Liability

Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • Our services will be uninterrupted, timely, secure, or error-free
  • Course content will meet your specific requirements or expectations
  • Any errors or defects will be corrected promptly
  • The platform will be compatible with all devices or browsers

No Guarantee of Results

While our courses provide valuable education and training, we make no guarantees about specific outcomes. Your success as a content creator depends on many factors including your effort, consistency, market conditions, and circumstances beyond our control. We do not guarantee:

  • Specific audience growth or follower increases
  • Income or revenue from content creation activities
  • Brand partnerships or sponsorship opportunities
  • Employment or career advancement

Limitation of Liability

To the maximum extent permitted by law, Create How shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages exceeding the amount you paid for the relevant course
  • Damages resulting from unauthorized access to your account
  • Third-party actions or content

Platform Changes

Platform algorithms, monetization policies, and features change frequently beyond our control. Course content reflects current best practices but we cannot guarantee continued effectiveness as platforms evolve. Students are responsible for staying current with platform policy changes.

7. Indemnification

You agree to indemnify, defend, and hold harmless Create How, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your use of our services, violation of these terms, infringement of any intellectual property or other rights, or any harmful acts toward other users.

8. Termination

By You

You may discontinue use of our services at any time. However, you remain responsible for any fees incurred before termination and may not be eligible for refunds except as specified in our refund policy.

By Us

We may suspend or terminate your access to our services immediately, without notice, for conduct that we believe:

  • Violates these terms or applicable laws
  • Could harm us, our services, or other users
  • Exposes us to legal liability
  • Is fraudulent or abusive

Effect of Termination

Upon termination, your right to access course materials and use our services immediately ceases. Provisions of these terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

9. Dispute Resolution

Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by discussing the matter with our team. Most concerns can be resolved quickly through direct communication.

Mediation

If informal resolution fails, both parties agree to attempt mediation before pursuing formal legal action. Mediation shall be conducted in Singapore by a mutually agreed mediator.

Arbitration and Jurisdiction

Any disputes not resolved through mediation shall be settled by arbitration in Singapore under the Singapore International Arbitration Centre (SIAC) rules. The arbitration shall be conducted in English. These terms are governed by the laws of Singapore, and you consent to the exclusive jurisdiction of Singapore courts.

10. General Provisions

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Create How regarding use of our services.

Modifications

We reserve the right to modify these terms at any time. We will notify users of material changes by posting updated terms on this page with a revised "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by our authorized representative.

Assignment

You may not assign or transfer these terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these terms without restriction.
